Family Law Dispute Mediation
In all mediations where children are involved, Astra Mediation applies a child-inclusive and child-focused approach. This means that the present and future needs and concerns of the children are given priority, at all times. In cases that involve children, it is recognised that their interests are best served when their parents can communicate and have some trust in each other. We apply mediation processes that encourage communication and trust, now and in the future.
Malcolm is a Family Dispute Resolution Practitioner. He can issue s.60I Certificates. All categories of matters can be the subject of mediations: including parenting, contact matters, and issues regarding property.
Workplace Disputes
Work can be an important aspect of people’s lives. Successful mediations allow people to remain at work and thrive, to their benefit and the benefit of the workplace. This is often achieved through the mediation process and its emphasis on openness and safe sharing of opinions.
Astra Mediation’s principal mediator, Malcolm Choat, has successfully mediated workplace disputes, resolved current difficulties and prevented future discord.
Personal Injury Claims
Astra Mediation’s principal mediator, Malcolm Choat, practiced for many years as a personal injury lawyer, undertaking both plaintiff and defendant work in equal proportions. With years of experience in the field, he is fully aware of the legal frameworks that apply to personal injury claims. He also knows that, sometimes, personal and even emotional concerns can influence parties’ decision-making. He applies this experience with his expertise as a mediator and psychologist to mediate best-possible outcomes and resolutions for all the parties.
Medical Negligence
Issues of liability, causation and damages frequently arise in medical negligence claims. Litigation is costly and lengthy. With all of its uncertainties, litigation can cause anxiety and make a bad situation even worse for all involved. Mediation with an experienced mediator – who knows the medico-legal context and the emotional complexities – can bring certainty and closure.
Astra Mediation’s principal mediator, Malcolm Choat, has the knowledge and expertise to assist parties to reach a resolution based on the best value of a claim and in a way that acknowledges the parties’ positions and interests, and achieves certainty.
Probate and Wills
Just because family or other relationships may be ruptured, it does not mean that parties are always prevented from resolving their differences. The court process, with its emphasis on finding “the facts”, is not always the most constructive or beneficial way forward for families or individuals.
Astra Mediation provides opportunities for parties to agree on what is right and proper for them, preserving as much as possible their dignity, and helping them to find an equitable outcome.
